MOBILE INTERNET

You need a polyphonic capable handset and be able to use the mobile internet on your phone for you to be able to download your ringtone from us. If you do not have mobile internet on your phone you will not be able to download your ringtone from us.

Mobile internet may also be known as WAP or GPRS and may incur a charge from your mobile network operator. This WAP or GPRS usage charge is not included in the cost of your ringtone.

We will not send the ringtone direct to your phone, we will send you a link which you will need to visit on the mobile internet where you can download the tone yourself.

Please ask your mobile network operator for more information on WAP or GPRS if you require it.

ORDER INFO

Pay Pal orders: We will email you the WAP link that you need to visit on your mobile phone to download your order, we will also send it by SMS as a 'Push Message' please ensure that your mobile phone's support for 'Push Messaging' is enabled.

Premium Rate orders: You need to stay on the line till the call is disconnected by us. We will then send you the link in a SMS 'Push Message'. Again, please ensure that your mobile phone's support for 'Push Messaging' is enabled.

Reverse Billed SMS orders: You must have enough credit on your phone, be in range and your phone must be turned on. We will send you confirmation of your order and receipt of payment in the billing message(s), we will also include the link you need to download plus we will also send you a 'Push Message' to make your download simpler.

REFUNDS POLICY

1) A refund may be offered at our discretion if it is not possible to deliver the product that you have ordered or an agreed replacement product to your handset.

2) Where a product is delivered by SMS, up to three attempts will be made to deliver the SMS at intervals of not less than 24 hours during which your handset should remain turned on in an area of good signal.

3) Where a product is delivered as a link to a WAP download, it is necessary for your handset to have the correct configuration for establishing a WAP session. Refunds will not be given for inability to download due to incorrect WAP configuration. If it is not possible to deliver the information (URL link) required to download the product via SMS, an alternative method such as email may be used.

4) Refunds will not be given for products that are incompatible with your make or model of handset and the compatibility chart should be checked prior to placing an order.

5) Refunds may be given after our support department has made all reasonable attempts to deliver the product that has been ordered and received sufficient information in order to be able to resolve a particular problem.

6) In such cases where a refund is not allowable, we may still at our discretion offer an alternative product.

7) In the case that a refund has been agreed, refunds for payment by premium rate will be limited to the advertised amount payable by dialling the premium rate number from a land-line. Calls from mobiles may cost more than this rate.

8) In the case that a refund has been agreed, refunds will be limited to the amount paid during the call or billed SMS which was made to order the product and not include other calls or consequential costs.

9) In the case that a refund has been agreed, refunds will be paid in UK Sterling by Pay Pal transaction within 5 working days of receipt from the carrier or network operator of the paid revenue. This will typically be within 45 - 60 days of the end of the month in which the order was received.

10) Refunds will not be made if there is evidence of fraudulent payment or in instances where the original payment is determined not to have been made by the party seeking the refund. Refunds will not be made if our server logs show that the download page has been accessed by either a cellular phone or common browser.

NOTICE TO MUSIC PUBLISHERS

Palace Marketing Limited has MCPS and PRS ringtone licences and is actively seeking licensing by applicable mechanical rights societies as well as music publishing companies. Each time a ringtone gets sold we pay MCPS and PRS 15% of the revenue which they in turn pass back to the original composer of the ringtone.

We are actively engaged in identifying, contacting, closing licenses with and paying all music publishing companies whose musical compositions are implicated by our ringtone service. It has accrued and budgeted a cash reserve for its licensing liabilities. Completing the licensing process with virtually innumerable individual music publishing companies is a time-consuming process. If your company has not yet been contacted, kindly make contact with us and will respond promptly on consummating an appropriate license.

This ringtones affiliate microsite and our server logs your navigation around the site, we may make some use of cookies to store data about you and assist you with your navigation around our site. Our server automatically logs your IP address, broswer and pages visited. You may disable or reject our cookies.

We do not send unsolicited SMS text messages or emails. We will not spam your mobile number or your email address. All data we collect is only used in house by Palace Marketing Limited and will never be sold to third parties.

Data would only be released to outside parties under instruction from a Court of Law.
